Terms of Use

These Terms apply to your use of this website and the Wave Battler game (together, the "Service"), operated by Ran Eilaty ("we", "us"). By using the Service you accept these Terms. If you don't accept them, don't use the Service.
1. Beta demo
The Service is free to play, with optional purchases. It is an experimental beta test version and may contain bugs, errors and unfinished features. We can change, reset, suspend or remove any part of it, including your progress, at any time and without notice. Your progress is saved in your own browser, or in your account if you sign in, and may be lost at any time (for example, if you clear your browser data). We have no duty to keep it, restore it, or keep the Service available.
2. Provided "as is"
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose, accuracy, availability, security, accessibility and non-infringement. We don't promise the Service will be uninterrupted, error-free, or free of harmful components.
Online co-op connects you directly with the player you share your code with. Only share your code with people you know.
3. Limitation of liability
To the maximum extent permitted by law, we won't be liable for any direct, indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, profits, or goodwill, arising from or related to the Service or these Terms, even if we were told such damage was possible. Our total liability for any claim relating to the Service is limited to ₪100. Nothing in these Terms limits liability that cannot be limited by law.
4. Health warning: play at your own risk
The game contains flashing lights, bright effects and fast motion. A small number of people may have seizures or other reactions when exposed to them, even without any history of epilepsy. If you or anyone in your family has had seizures or epilepsy, consult a doctor before playing. Stop playing immediately and consult a doctor if you feel dizzy or nauseous, have blurred vision, eye or muscle twitches, disorientation, or any unusual discomfort. Take regular breaks. You play at your own risk.
5. Fair use
Don't misuse the Service. In particular, don't: copy, modify, redistribute, re-host, or embed the game on other sites; reverse-engineer or extract its code or art; interfere with or disrupt the Service; block, hide, or tamper with ads; or use it for anything unlawful.
6. Ownership
The game, its code, art, sound, names and this website belong to Ran Eilaty. All rights reserved. Using the Service gives you no ownership or licence beyond playing it in your browser for personal, non-commercial fun.
7. Ads and other sites
The Service may show ads served by third parties such as Google. We don't control and aren't responsible for ads, advertisers, or any third-party website or product they link to. Your dealings with them are only between you and them.
8. Children
The Service isn't directed at children under 13. If you're under 18, use it only with a parent or guardian's permission.
9. Indemnity
You agree to indemnify and hold us harmless from claims, losses and costs (including reasonable legal fees) arising from your misuse of the Service or your breach of these Terms.
10. Changes and ending access
We may update these Terms at any time by posting a new version here. Continuing to use the Service means you accept the updated Terms. We may stop offering the Service, or block anyone's access, at any time.
11. Law and courts
These Terms are governed by the laws of the State of Israel. The competent courts in Tel Aviv-Jaffa have exclusive jurisdiction over any dispute.
12. General
If any part of these Terms is found unenforceable, the rest stays in effect. These Terms are the whole agreement between you and us about the Service.
13. Purchases and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing and tax are governed by Paddle's Buyer Terms (paddle.com/legal/checkout-buyer-terms).
Legendary skins are digital cosmetic items. They are tied to your account, need you to be signed in, and can be used for as long as the game is online. They have no cash value and can't be transferred or exchanged.
Refunds. If you're not satisfied with a purchase, you can request a full refund within 14 days of your order date, no questions asked. To request a refund, visit paddle.net or email us. Refunds are processed by Paddle. When a purchase is refunded, the items it unlocked are removed from your account.
